in this Court's original jurisdiction, which petition for review seeks to have this Court revoke the Environmental Quality
Board's (EQB) redesignation of Valley Creek from a less protected level, "Cold Water Fishes" (CWF), to the highest protected
level, "Exceptional Value" (EV). Presently before this Court are preliminary objections to Rouse's complaint filed by the
EQB and the Department of Environmental Resources (DER)(collectively, respondents).
